Terms & Conditions of Sale

(Required Acceptance Prior to Order Confirmation)

1. Acceptance of Terms
   By placing an order with Tyler Gray Models (“TGM”), you agree to be bound by these Terms & Conditions and all related Shipping, Return, Insurance, Tariff, and Special Order policies. These terms form a legally binding agreement.

2. Ordering Process
   You agree to provide accurate and complete information. Once an order is submitted, it cannot be modified or canceled, except as allowed under TGM’s published policies.

3. Pricing
   All prices are listed in USD and do not include shipping, taxes, duties, tariffs, or import fees unless explicitly stated. The customer is responsible for all applicable government-imposed charges.

4. SHIPPING & FLAT-RATE SHIPPING (PLEASE READ)

• The website automatically applies a $20.00 flat-rate shipping charge at checkout.
• This $20.00 charge is a preliminary estimate ONLY and is NOT the final shipping cost.
• Actual shipping costs depend on item size, weight, destination, packaging requirements, and carrier rates.
• Large, heavy, fragile, or special-order items may require ADDITIONAL shipping charges.

If actual shipping costs exceed the flat-rate amount, the customer agrees to pay the additional shipping charges before the order ships. Orders will not be shipped until final shipping costs are approved and paid.

Tyler Gray Models will select the most cost-effective and efficient shipping method unless the customer requests otherwise.

Once a shipment is handed to the carrier, carrier tracking marked “DELIVERED” constitutes fulfillment of the order.

5. SHIPPING INSURANCE (IMPORTANT)

Shipping insurance is NOT included by default.
Customers who wish to insure their shipment must request and purchase insurance prior to shipment.

If shipping insurance is not requested, the customer assumes ALL risk of loss, theft, or damage once the shipment is tendered to the carrier.

6. Invoicing and Payment
   Invoices will reflect the total amount due, including final shipping charges. Payment is due within 3 business days of the invoice date. Unpaid invoices may result in cancellation.

7. Order Confirmation
   Order confirmation emails acknowledge receipt only and do not constitute acceptance of the order.

8. Acceptance of Order
   All orders are subject to acceptance by TGM. We reserve the right to refuse or cancel orders due to availability, pricing errors, shipping constraints, or suspected fraud.

9. SPECIAL ORDERS

Any item not currently in stock at Tyler Gray Models is considered a SPECIAL ORDER.
Special-order items may ship directly from Germany or route through TGM before final delivery.

Special orders are subject to restocking fees and cancellation restrictions as outlined in our Shipping & Return policies.

10. Returns and Refunds
    All returns and refunds are governed by TGM’s published Return Policy.

11. TARIFFS & TRADE FEES

Tariffs, duties, customs fees, and trade-related charges may be assessed before or after shipment.
All such charges are the sole responsibility of the customer and are NON-REFUNDABLE.
Tariffs are not grounds for order cancellation, refusal, or refund.

12. BINDING OBLIGATION TO PAY

By submitting an order, you acknowledge that this constitutes a binding obligation to pay for the products and all associated shipping and government-imposed charges.

13. Changes to Terms
    TGM reserves the right to modify these Terms & Conditions at any time. Changes take effect immediately upon posting.
